Agreement Overview
These Terms of Service ("Terms") govern your use of SparkSchool AI's educational platform and services. By accessing or using our platform, you agree to be bound by these Terms. If you are accepting on behalf of a school or organization, you represent that you have the authority to bind that entity. Our platform is designed to comply with FERPA, COPPA, and other applicable child data protection laws.
Child Safety & Student Data Protection
Protecting students is our top priority. We are committed to:
- COPPA Compliance: We comply with the Children's Online Privacy Protection Act for users under 13
- FERPA Compliance: We operate as a school official with legitimate educational interest under FERPA
- No student advertising: We never use student data for advertising or marketing purposes
- Data minimization: We collect only the minimum data necessary for educational purposes
- Parental rights: Parents have the right to review, correct, and delete their child's data
- Safe content: Our AI is designed to generate age-appropriate, education-focused content only
Data Processing Agreements
For school and district accounts, we offer:
- Standard Data Privacy Agreements (DPAs) upon request
- Compliance with state-specific student privacy requirements
- Transparency reports about data usage and security
- Custom contractual terms for enterprise accounts
Account & Access
Eligibility
- Teachers and school staff must be authorized by their institution
- School accounts require authorization from school administration
- For students under 13, verifiable parental consent is required through the school
- You must provide accurate and complete registration information
Account Responsibilities
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access
- You are responsible for all activities under your account
Permitted Use
SparkSchool AI is designed for educational purposes. You may use our platform to:
- Create lesson plans, assessments, and educational materials
- Generate curriculum-aligned content for classroom use
- Track and analyze student progress and learning outcomes
- Collaborate with other educators within your school
- Share resources within the SparkSchool community
Prohibited Activities
You agree NOT to:
- Use the platform for any unlawful purpose
- Generate inappropriate, harmful, or offensive content
- Attempt to bypass usage limits or security measures
- Share your account credentials with unauthorized users
- Resell or redistribute platform content without authorization
- Use automated tools to scrape or extract content
- Interfere with platform operations or other users' access
- Collect or share student data outside of permitted educational purposes
Intellectual Property
Our IP
SparkSchool AI, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the platform for its intended educational purposes.
Your Content
You retain ownership of content you create using our platform. By uploading content, you grant us a license to store, process, and display it as necessary to provide our services. AI-generated content may be used for improving our models in anonymized form only.
Disclaimers & Limitations
AI-Generated Content
While we strive for accuracy, AI-generated content may contain errors or inaccuracies. Teachers are responsible for reviewing all content before classroom use. We do not guarantee that content meets specific curriculum requirements without review.
Service Availability
We aim for high availability but cannot guarantee uninterrupted service. The platform is provided "as is" without warranties of any kind, express or implied.
Limitation of Liability
To the maximum extent permitted by law, SparkSchool AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
Subscription & Payment
- School subscriptions are billed as agreed in your service contract
- Pricing is subject to change with 30 days notice
- Refunds are handled according to our Refund Policy
- Non-payment may result in service suspension
Termination
We may suspend or terminate your access for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the platform ceases, and we will delete your data according to our data retention policies (within 30 days for school data).
Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Ahmedabad, Gujarat, India. For users in other jurisdictions, local consumer protection laws may apply.
