Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Qubiverse Learning Solutions Pvt. Ltd., a company based in Gujarat, India, which owns and operates SparkSchool AI ("SparkSchool", "we", "us"). They govern your use of sparkschool.ai, app.sparkschool.ai, and related SparkSchool services (the "Service"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

2. Who Can Use SparkSchool AI

SparkSchool AI is built for teachers, school administrators, and other education professionals aged 18 or older, acting on behalf of themselves or a school. If you're using the Service on behalf of a school, you confirm you're authorised to accept these Terms for that school.

3. Your Account

You're responsible for keeping your account credentials confidential and for all activity under your account. Let us know immediately at hello@sparkschool.ai if you suspect unauthorised access.

4. Plans, Billing & Payment

SparkSchool AI offers a Free plan and a paid Pro plan, as described on our Pricing page. Pro plan fees are billed in advance, monthly or annually, and are charged automatically to your payment method until you cancel.

• You can upgrade at any time; the change takes effect immediately.
• Downgrades take effect at the start of your next billing cycle.
• You can cancel at any time from your account settings — your content remains accessible on the Free plan.
• Refunds are handled under our Refund Policy.
• School-wide deployments are priced separately under a signed order form or agreement, which takes precedence over these Terms where the two conflict on commercial terms.

5. Acceptable Use

You agree not to:

• Use the Service to generate content that is unlawful, harassing, discriminatory, or sexually explicit, or that targets a specific student in a harmful way.
• Attempt to reverse-engineer, scrape, or interfere with the Service's infrastructure or security.
• Share your account credentials with people outside your school, or resell access to the Service.
• Upload student personal data beyond what's reasonably necessary for the material you're creating.

6. AI-Generated Content

SparkSchool AI generates lesson plans, assessments, and other materials using AI models. Like any AI system, outputs can occasionally be inaccurate, incomplete, or not fully aligned to your curriculum despite our best efforts. AI generates, you decide — you're responsible for reviewing and editing AI-generated content before using it with students.

7. Intellectual Property

You own the content you generate using SparkSchool AI, subject to the underlying rights of any material you upload. We own the Service itself — our software, models, designs, and trademarks — and nothing in these Terms transfers that ownership to you. You grant us a licence to process your inputs and outputs solely to provide and improve the Service, consistent with our Privacy Policy.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate accounts that violate these Terms, pose a security risk, or remain inactive for an extended period, with notice where practical.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, SparkSchool AI is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated content. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Governing Law

These Terms, and any non-contractual obligations arising from them, are governed by the laws of India. Subject to any mandatory dispute-resolution rights under applicable law, the courts of Ahmedabad, Gujarat, India have exclusive jurisdiction over disputes connected with the Service or these Terms.

Before starting formal proceedings, you and Qubiverse Learning Solutions Pvt. Ltd. agree to make a good-faith effort to resolve the dispute by written notice and discussion for at least 30 days.

11. Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes by email or in-app notice before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
